These Terms of Service (“Terms”) apply to services provided by Beach Grass OBX LLC, doing business as Premier Exterior Services (“Premier Exterior Services,” “Premier,” “we,” “us,” or “our”). By requesting, approving, scheduling, or allowing Premier Exterior Services to perform services, the customer (“Customer”) agrees to these Terms.

1. Estimates and Authorization

Estimates are based on the information and conditions reasonably available at the time the estimate is prepared. Unless otherwise stated, estimates may be subject to change if the scope of work, site conditions, measurements, material requirements, accessibility, or other circumstances differ from what was originally anticipated.

Approval of an estimate, acceptance of a recurring service, electronic authorization, written authorization, or permitting Premier Exterior Services to begin work constitutes authorization to perform the services described.

Additional work outside the original scope may result in additional charges. When reasonably practical, Premier Exterior Services will obtain Customer approval before performing substantial additional work.

2. Scheduling

Service dates and arrival times are estimates unless specifically agreed otherwise. Scheduling may be affected by weather, staffing, equipment availability, property access, material availability, safety concerns, or other circumstances beyond our reasonable control.

Premier Exterior Services may reschedule work when conditions make performing the service unsafe, impractical, or likely to produce an unsatisfactory result.

Recurring lawn and property-maintenance services may be adjusted as necessary because of weather, seasonal growth, property conditions, holidays, or operational requirements.

3. Customer Access and Property Preparation

Customer is responsible for providing reasonable access to all areas necessary to perform the scheduled work.

Customer should remove or secure fragile, valuable, or easily damaged items from work areas before service. This may include decorations, furniture, toys, hoses, vehicles, planters, flags, outdoor electronics, and other personal property.

Gates should be unlocked or access instructions provided before the scheduled service.

Premier Exterior Services is not responsible for delays, incomplete service, or additional costs resulting from inaccessible areas or conditions that prevent reasonable access to the property.

4. Pets, Children, and Occupants

Customer is responsible for keeping pets, children, residents, tenants, guests, and other persons safely away from active work areas.

Pets must be secured during service when necessary for the safety of the animal, our employees, and our equipment.

Premier Exterior Services is not responsible for pets escaping through gates or work areas when the Customer has failed to properly secure the animal or notify us of special access requirements.

5. Utilities and Property Systems

Customer is responsible for ensuring that utilities and property systems necessary to perform the contracted service are operational and accessible when required.

This may include exterior water supplies, electrical outlets, irrigation systems, gates, locks, and other property infrastructure.

Customer must disclose known problems with plumbing, electrical systems, irrigation systems, siding, roofing, windows, doors, fixtures, drainage systems, or other property components that could reasonably affect the work.

6. Pre-Existing Conditions and Damage

Premier Exterior Services takes reasonable care while performing services. However, exterior surfaces, landscaping, fixtures, structures, and equipment may have pre-existing deterioration or defects that are not readily visible before work begins.

Premier Exterior Services is not responsible for damage resulting from pre-existing conditions, defective installation, deterioration, rot, corrosion, loose materials, failing paint or coatings, oxidation, improperly sealed windows or doors, defective plumbing or electrical components, brittle materials, hidden damage, or other conditions outside our control.

Customer agrees to notify Premier Exterior Services promptly if they believe our work caused damage. We must be given a reasonable opportunity to inspect the alleged damage before repairs or alterations are performed by another party.

7. Lawn Care and Landscape Services

Customer is responsible for identifying or marking hidden objects or hazards that may be damaged by or cause damage to lawn equipment, including irrigation heads, shallow wiring, landscape lighting, invisible fencing, drainage components, utility covers, cables, pipes, stakes, and other concealed objects.

Premier Exterior Services is not responsible for damage to improperly installed, concealed, unmarked, or inadequately protected objects located within normal mowing, trimming, edging, landscaping, or maintenance areas.

Grass-cutting frequency and appearance may vary because of weather, rainfall, drought, growth rate, soil conditions, seasonal changes, and other environmental factors.

Premier Exterior Services may postpone mowing when turf or soil conditions are excessively wet or when mowing would likely cause rutting, turf damage, or an unacceptable result.

8. Exterior Cleaning and Pressure/Soft Washing

Customer acknowledges that exterior cleaning may reveal pre-existing discoloration, oxidation, fading, staining, deterioration, repairs, mismatched materials, or other conditions that were previously obscured by dirt, algae, mildew, or organic growth.

Some stains, oxidation, rust, artillery fungus, mineral deposits, paint discoloration, and other conditions may not be completely removable through standard cleaning.

Customer is responsible for ensuring windows and doors are properly closed and reasonably watertight before service.

Premier Exterior Services is not responsible for water intrusion resulting from defective seals, improperly installed windows or doors, pre-existing leaks, structural defects, or other deficiencies in the property.

9. Chemicals and Treatments

Certain services may involve detergents, cleaning agents, herbicides, pesticides, fertilizers, or other products appropriate to the service being performed.

Products will be used in accordance with applicable laws, labeling requirements, and normal professional practices.

Customer is responsible for informing Premier Exterior Services of known sensitive areas, plants, animals, water features, wells, gardens, or other property conditions requiring special consideration before treatment.

Results of lawn, weed, pest, plant, or chemical treatments can vary because of weather, soil conditions, irrigation, plant health, application timing, resistance, environmental conditions, and other factors outside our control. Unless specifically stated in writing, no particular biological or cosmetic result is guaranteed.

10. Materials

When materials are included in a project, reasonable variations in color, texture, size, appearance, availability, and natural characteristics may occur.

Premier Exterior Services is not responsible for normal variations in mulch, stone, lumber, plants, pavers, soil, aggregates, or other natural or manufactured materials.

Material quantities are estimated based on expected project requirements. Additional materials required because of unforeseen site conditions or Customer-requested changes may result in additional charges.

11. Changes to Scope of Work

Customer-requested changes or additions to an approved project may require additional labor, equipment, materials, or scheduling and may result in additional charges.

Premier Exterior Services reserves the right to stop work and discuss a revised scope or price when unexpected conditions substantially alter the work required.

12. Payment

Payment is due according to the terms shown on the estimate, invoice, recurring-service agreement, or other applicable service documentation.

Customer is responsible for reviewing invoices and notifying Premier Exterior Services promptly of any questions or disputed charges.

Payments made through electronic payment systems are subject to the processing terms of the applicable payment provider.

Customer remains responsible for all legitimate unpaid balances for services performed.

13. Recurring Services

Recurring-service customers authorize Premier Exterior Services to continue performing the agreed recurring services until the service is canceled, suspended, or otherwise modified.

Recurring services may be invoiced after each visit, periodically, or according to another billing arrangement communicated to the Customer.

Either party may discontinue recurring service unless a separate written agreement provides otherwise.

Amounts already earned for completed services remain due after cancellation.

14. Past-Due Accounts and Collection Costs

Premier Exterior Services may suspend future services on accounts with past-due balances.

Customer is responsible for reasonable costs incurred in collecting legitimate unpaid balances to the extent permitted by applicable law.

15. Photographs and Documentation

Premier Exterior Services may photograph or document work areas before, during, and after service for quality control, employee documentation, dispute resolution, estimating, and business-record purposes.

Photos containing identifying information will not be publicly used for advertising without appropriate permission when such permission is legally required.

16. Weather and Uncontrollable Conditions

Premier Exterior Services is not responsible for delays or inability to perform services resulting from severe weather, storms, flooding, excessive heat, equipment failure, material shortages, road closures, governmental restrictions, emergencies, unsafe working conditions, or other circumstances reasonably beyond our control.

17. Workmanship and Service Concerns

If Customer believes a service was performed incorrectly or incompletely, Customer should contact Premier Exterior Services as soon as reasonably possible so we have an opportunity to inspect and, when appropriate, correct the issue.

Any warranty specifically offered for a project will be stated in writing. Except for warranties expressly provided in writing, results affected by weather, biological conditions, pre-existing property conditions, normal wear, or factors outside our control are not guaranteed.

18. Limitation of Liability

To the fullest extent permitted by applicable law, Premier Exterior Services will not be responsible for indirect, incidental, special, or consequential damages arising from the performance or inability to perform services.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

19. Electronic Communications

Customer agrees that Premier Exterior Services may communicate regarding estimates, appointments, invoices, payments, service updates, account matters, and other service-related information by telephone, email, or text message using contact information provided by the Customer.

Consent to receive marketing text messages is not a condition of purchasing services. Customers may opt out of marketing text messages at any time by replying STOP. Message and data rates may apply.

20. Privacy

Customer information is used for legitimate business purposes including providing services, scheduling, billing, customer support, maintaining business records, and communicating with customers.

Premier Exterior Services does not sell Customer mobile phone numbers or SMS consent information to third parties for their marketing purposes.

SMS opt-in data and consent will not be shared with third parties for unrelated marketing purposes.

21. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

22. Severability

If any portion of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

23. Entire Agreement

These Terms, together with the applicable estimate, invoice, service agreement, work order, or other written documentation provided by Premier Exterior Services, constitute the agreement regarding the services being performed.

If specific written terms in an approved estimate or contract conflict with these general Terms, the specific written terms for that project will control.

By approving an estimate, requesting or scheduling service, or permitting Premier Exterior Services to perform work, Customer acknowledges that they have read and agree to these Terms of Service.
